Unfortunately, we are and, yes, we have something called the CIA that can "arrest" (but they usually just kill) anyone, anywhere, at any time (please reference Oliver North and the Iran-Contra for a great refresher or beginner course on such).

Really though, if you think about it, that's pretty mild for what we do to teenager (and pre-teens now). Legally, for serious crimes, they are pretty much tried as adults (murder, theft, ****), why not the age old tract of terrorism?
