I just saw a new commercial for American Express credit cards where they use footage of such beloved celebrities as Jim Henson and other dead guys.

1. Fuck their next of kin. They did jack shit and were born rich. To put your father's memory though Photoshop to get extra money you didn't earn is shameful.

2. Fuck the companies. I know that AE isn't the first. You've seen dead men being ***** for all their worth for everything from vacuums to burgers. Honestly, if you've ever thought to yourself, "Gee, I can't think of anything on my own, let me **** a corpse." you need to drop dead yourself.

That is the reason I mostly stopped using Apple products -- their doing this type of marketing.

I'm not saying if I agree with it or not, but it's not necessarily a cost issue - it's that a dead person is a known entity. You won't spend 5 million on a campaign only to see your star running from the cops at 2am, or humping a goose on YouTube. These days that's far more of a concern than how much someone charges per hour.

Image rights in these applications also aren't as simple as you'd think - the next of kin are often not the main party as there's no posthumous concept of personal image right (if the CGI is extracted from footage, it's the recording's rights owners who hold derivative claim, not the person in it. You can't per se claim rights in the CGI version of yourself unless you've registered a design claim in life that covers it).

You've had a lot - from Steve McQueen (Ford) to Marilyn (Chanel), mostly as a result of Corbis who've pretty much owned the market in "posthumous re-incorporation" for the last few years. Corbis, of course, being a Bill Gates project and so enamored of all things digitally-licensed, including your dead granny.
