    After Amelia's thread on the new clothing site, I figured I'd save myself some time on a few domains I can use in the coming months. It is unbelievable what is simply being sat on (and often not even properly parked) Yeah, they have the right under current law (in most cases). Yeah, it's a free market online. Good god though. I had one obscure domain that lapsed. This chinese jackass buys it and tries to sell it back for $2800. I hate these fucking cockroaches. Can't they exploit people in a way that doesn't fuck every creative person on the damn internet??

    I seriously want to smash this pigfucking odes to mediocrity.

    I totally agree with you. I have several domains, and honestly if they stop making me money, then i would gladly give them up.

    I am so glad I don't have to start up a new business right now... It was hard enough trying to decide on a name without the internet, now it is almost impossible.

    Oh man, that sucks. I'm consistently surprised by the way some people overvalue sites and domains and the way a lot of people will just let their sites turn into fake search engines. I've had to buy stuff that way, OEC, and it is no fun. If you have a solid legal claim on the domain name, ICANN ajudication is around $900 last I checked, so you should be able to negotiate down to $900 or less if the person is technically a cybersqatter. I'm not sure what area of law you are concentrating in, but cybersquatters generally do want to sell, so, if you can hold your nose long enough to negotiate with them, you can probably at least get a better price. I've certainly never enjoyed having to give a cybersquatter anything though, so much sympathy.

    I have no experience in Intellectual Property/Cyberspace Law. I doubt I have a solid legal claim though. This is a gig that really never got off the ground. We did have it in .org form as a blog. There is obviously a copyright on the banner and artwork. I tried to negotiate through godaddy. The guy sends me an email with the list of some company saying he only dealt with them and to remit $2800. I offered market value (the standard practice for the broker, it was about $150) He just said no deal, goodbye haha. That particular domain isn't one I need right now, I was helping someone else. Still, I just checked a bunch of obscure names (including antemortem) and all were taken, unused, and appeared to have been so for years. I did find contact info on those though.     The worst thing about a bunch of those name guys is that they seem to get off on taking something which means nothing to them and which matters to someone else. I admit I've given them dough in the past, but that is the part that makes it rankle the worst.

    We lost the original Blue Blood sites on the web to people kinda like that.

    That's the impression this guy gave me too. Luckily, it wasn't a crucial site. It just annoys me that so many domains are just sat on like that.

    What really gets me is the Knock-off porn sites.... I am not in favor of the .XXX, but there are times when my kids are playing games, and I am trying ot find things, and of course I miss type.. and BAM... "Hey kids, close your eyes a minute"

    i always kinda wondered what happens to websites, and how theyre sold and made and stuff... now i know the selling part... i think the making part i totally wouldnt get at all hahaa!

    Yeah I hear you. It is a difficult issue for me. I took a class on Sexuality and Gender Law. Seeing the interconnections between sexual expression, laws concerning consensual sexualities, reproductive choices, and basic liberty forced me to take a very sharp libertarian turn in my judicial outlook.

    An xxx categorization would hit erotica sites hardest. The potential for abuse is very high. What may be omitted? Thus, I oppose the xxx concept as well. At the same time, I think as a conscientious parent this should occur less. I've pulled up porn sites based on some fairly innocuous searches.

    I see a moral crisis amongst some who use this amazing tool (the internet). Unfortunately, I do not see a legal remedy that would not impact legitimate sites featuring erotica. The cybersquatting issue, as you clearly recognize, falls along similar lines..

    There are a lot of issues which need to be decoupled from erotic expression in general. It is a damn difficult issue which even my Professor admitted she was struggling with. For now, we just need to be on the lookout for our kids and exploitation of kids online. There is no real answer beyond that. You definitely don't want Scalia taking out the sword and putting erotic businesses on their needs. The same goes for contractual agreements therein. Models need to be more legally savvy. The law won't cover what may appear on a site in Cyprus run by the Russian mafia.

    Lot there, man.

    (should read Scalia putting erotic business on its knees) Let's be clear though: I don't make these warnings to be hyperbolic. They are simply things people should be aware of. The actual changes would be marginal but fatal for start-up sites. They could impact less popular sexualities. Scalia is brilliant. I mention him as he is absolutely brilliant. I don't even disagree with him on other issues. Morality? Dangerous man. Very dangerous. Respect the man immensely. Dangerous though. He'll be writing the decisions should they get the 5th vote.

    It's not a pretty business. Luckily, there are now more effective ways to make getting poached more difficult. There are legitimate reasons to sit on a few domains, these jackasses will take em before u get ur gig going. It really fucking sucks.
